Privacy Policy
Last updated: January 27, 2025
This Privacy Policy describes how Wild Software, Inc. (doing business as “Wild,” “we,” “us,” or “our”) collects, uses, and discloses your personal information when you visit, access, or use our websites (including thatswild.com (the “Site”)), play Factions or Wild (collectively, our “Games”), or otherwise communicate with us regarding these services (collectively, the “Services”). For purposes of this Privacy Policy, “you” and “your” means you as the user of the Services, whether you are a customer, a website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use or access any of the Services.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will post the revised Privacy Policy on the Site, update the “Last updated” date above, and take any other steps required by applicable law.
How We Collect and Use Your Personal Information
To provide the Services, we collect—and have collected over the past 12 months—personal information about you from a variety of sources, as set out below. The information we collect and use varies depending on how you interact with us.
In addition to the specific uses set out below, we may use the information we collect about you to:
• Communicate with you,
• Provide or improve the Services,
• Comply with any applicable legal obligations,
• Enforce any applicable terms of service, and
• Protect or defend the Services, our rights, and the rights of our users or others.
What Personal Information We Collect
The types of personal information we obtain depend on how you interact with our Site and Games. When we use the term “personal information,” we refer to information that identifies, relates to, describes, or can be associated with you. The following sections describe the categories and specific types of personal information we collect.
1. Information We Collect Directly from You
Information that you directly submit to us through our Site or in our Games may include:
• Contact Details: Your name, address, phone number, and email address.
• Order Information: Your name, billing address, shipping address, payment confirmation, email address, and phone number when you purchase products or services.
• Account Information: Username, password, security questions, and similar credentials for creating or securing your account.
• Customer Support Information: The information you choose to include in communications with us (e.g., help requests, support tickets).
• Social Media Handles: If you opt to provide social media usernames or handles for in-game features (such as content-sharing with social media platforms).
Some features of the Services require you to provide certain personal information. You may elect not to provide this information, but doing so may limit your ability to use or access certain features.
2. Information We Collect about Your Usage
We may automatically collect certain information about your interaction with the Services (“Usage Data”). To do this, we may use cookies, pixels, and similar technologies (“Cookies”). Usage Data may include:
• How you access and use our Site or Games, including device information, browser information, and information about your network connection.
• Your IP address and other details regarding your interactions with the Services.
• Game metrics and usage logs to provide support and improve gameplay experiences.
3. Information We Obtain from Third Parties
We may obtain information about you from third parties, including vendors and service providers who collect information on our behalf, such as:
• Platform Providers: For example, Meta (Oculus) collects certain information to manage your VR account and process in-app purchases.
• Payment Processors: These collect information (e.g., bank account, credit or debit card information, billing address) to fulfill your orders or in-app purchases in order to perform our contract with you.
Any information we obtain from third parties will be treated in accordance with this Privacy Policy.
Information We Collect in Game
Meta User ID: If you access Factions through your Meta Quest or Oculus account, the Game automatically creates and updates a game account tied to your Meta User ID (a unique string of numbers provided by Meta). Your game account includes:
• Your chosen display name,
• Information about owned items or cosmetics,
• Your purchase history within the Game,
• Any virtual currency balances in your Game account.
If you choose to create or link an account via our own system in the Game, we similarly collect necessary account information (username, email, or other credentials) to manage your access.
Note: For your own safety, do not disclose personal information (e.g., full name, address) to others while using the Services. Our developers and support staff will never ask for personal information beyond what is needed to assist with account issues or troubleshooting.
Voice Data and Communication
Factions (and/or Wild) may be social VR environments focused on content creation and interaction with friends. At this time, we do not record or store voice chats for moderation or analysis. However, we may use automatic in-game voice features solely to enable real-time communication. If this policy changes, we will update it here and notify you as required by law.
How We Use Your Personal Information
Below are the main purposes for which we use personal information.

3. Security and Fraud Prevention
We use personal information to detect, investigate, or take action regarding possible fraudulent, illegal, or malicious activity. If you create an account, you are responsible for keeping your login credentials safe. If you believe your account has been compromised, please contact us immediately.
4. Service Improvement and Customer Support
In our legitimate interests, we use personal information to provide customer support and improve our Services based on usage metrics and player feedback.

You can choose to set your browser to remove or reject Cookies. However, blocking Cookies may negatively impact your user experience, and some features may no longer function correctly. We do not respond to “do not track” signals at this time.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for business or operational purposes. Such circumstances include:
• Service Providers: Vendors who perform services on our behalf (e.g., IT management, payment processing, data analytics, cloud storage, shipping).

We do not sell your personal information or share it with third-party advertisers for cross-context behavioral advertising.
Third Party Websites and Links
Our Site or Games may contain links to websites or online platforms operated by third parties (e.g., social media sites). If you follow these links, you should review the privacy and security policies of those third-party sites. We are not responsible for the privacy or security of such sites, including the accuracy or reliability of information on them. Our inclusion of any third-party links does not imply endorsement, except as noted within the Services.
Children’s Data
Our Services are not intended to be used by children, and we do not knowingly collect personal information about children. If you believe your child has provided us with personal information, please contact us using the details below to request its deletion. We do not knowingly “share” or “sell” personal information of individuals under 16 years of age.
Security and Retention of Your Information
We use commercially reasonable security measures to protect your personal information. However, no security measures are perfect, and we cannot guarantee absolute security. Information you send to us may not be secure in transit. We recommend not using insecure channels to communicate sensitive or confidential information.
We retain personal information for as long as necessary to maintain your account, provide the Services, comply with legal obligations, resolve disputes, or enforce our agreements. Retention periods vary depending on the type of information and purpose of collection.
Your Rights
Depending on where you live, you may have certain rights regarding your personal information, including the right to access/know, delete, correct, or port your data, and in some cases, the right to restrict processing or withdraw consent. You may also have the right to appeal our decisions or lodge a complaint with a regulatory authority.
Right to Deletion for All Users: We recognize and honor the right of all users, regardless of region, to request the deletion of their personal information. If you wish to exercise this right, please contact us using the information provided below. We may require additional information to verify your identity (e.g., email address, account details). If you designate an authorized agent to make a request on your behalf, we may also require proof of authorization. Please note that certain exceptions may apply—for example, where we need to retain data to comply with legal obligations or to complete a transaction you have requested.
Marketing Communications: You can opt out of promotional emails or text messages at any time by following the unsubscribe instructions in those communications. We may still send non-promotional messages about your account or transactions.
To exercise any rights available to you, please contact us using the information provided below.
Complaints
If you have any complaints about how we process your personal information, please contact us first so we can address your concerns. If you are not satisfied with our response, you may have the right to contact your local data protection authority or another official agency in your jurisdiction.
International Users
We operate primarily in the United States, but we may transfer, store, and process your personal information outside the country you live in, including to jurisdictions where data protection and privacy regulations may differ from those in your home country. If we transfer your personal information out of Europe or the UK, we rely on recognized transfer mechanisms like the European Commission’s Standard Contractual Clauses (SCCs) or other legally acceptable methods.
